第四届业委会委员候选人自愿签署承诺书

如果当选第四届业委会委员,我自愿签署如下承诺:

  1. 我不会接受物业企业(包括小区现物业公司,或参与竞标物业公司等),与小区业务往来的承包商,分包商,供应商等的宴请,礼物,或者超过普通业主的特殊照顾。
  2. 我不会将自己的直接或者间接的关联企业(包括但不仅限于持股,任职,或者有其他利益关系)和小区发生任何业务往来。
  3. 我保证在涉及到利益冲突的时候,第一时间向业主小组代表/业主委员会说明并且在做相关决定时回避。
  4. 我保证遵守小区《业主大会议事规则》《管理规约》和《公积金管理办法》,以及国家,市级相关法律法规。
  5. 我保证在微信群,业主接待日,例行会议等方式和场合积极回复业主的问题,帮助业主了解小区状况和相应法规。
  6. 我保证在自己参与的所有涉及到小区公共事务的会议中,允许业主使用直播,现场或者远程参会的方式等业主选择的方式旁听。
  7. 我已经签署《无条件辞职信》,交给业委会顾问监督委员会保存。当小区监督委员会超过2/3委员同意时,代我向业委会提交辞职信。

Contact your landlord, and ask them to vote in the coming Owners’ Committee Election starting at Feb 2021

In recent years, we all see the club house facilities for children and adults have become dilapidated and are in urgent need of proper overhaul. The lobbies were no longer as clean as before, and the service quality of the property management was getting increasingly worse.
But if we do nothing, even worse thing will happen, including:
1. The Property Management Fee will increase from current 6.5 RMB/sqm to 9.5 RMB, a 46% increase. We all need the landlords to vote NO to this motion.
2. The club house will continue to be worsen, and the service will continue to shrink because the community is running on deficits in 2019, and 2020 and years to come.
3. The current management company will renew another 5 year contract that we cannot change until 2026. We also need your landlord to vote NO to this.

It is a normal process that every five years, Property Owners gather and vote for the next Owner’s Committee, and vote to decide whether to renew the contract of the management company. But previous years, since we cannot reach out to enough owners, the vote can be easily manipulated, eventually causing these strong frustrations for tenants and owners. This year, this should not happen again.

All these past and present misdeeds are in total disrespect of a proper usage of the already colossal management budget.

That’s also why many landlords were very grateful when their tenant pass the information to them. Although they don’t live in the community, they got frustrated that their investment value does not grow as with proper management, and bear 4 million to 15 million losses in value. They are also unhappy if their tenants tell them they may consider moving out. This is maybe the first time we have an action plan and have tens of volunteers to improve the community. They will appreciate your help to let them know the change.
Please help to pass on the information to your landlord, and ask them to add WeChat (using the QRCode below or just add huixianju99). You’ll do much good to our whole community, and help stop well known dirty practices impacting our daily lives in a totally unfair fashion.

业主问答之十五:如果明年的业委会选举不符合法律程序怎么办?

问:我很担心如果明年的业委会选举过程不公开,不透明,不按照法律规定的方式来走,然后选出来的业委会委员还是现在的,或者更加不作为的业委会委员,我们除了卖房子离开以外难道就没有办法了吗?

答:不是的。

首先我们相信街道,房办,还有居委会严格按照法规来组织业委会换届选举的,您说的情况不太可能发生,最终选出来的应该是业主投票最多的候选人。

如果您说的情况真的发生了,也不要担心。如果真的第四届业委会成员是违反大多数业主的意愿,只要20%的业主发起,可以召开《临时业主大会》然后依法对《关于罢免全体业委会成员》的议案,然后进行业委会补选程序。

We are your neighbors at the Summit. We love our community and care about its future as much as you do.

But in recent years, the club house facilities have become dilapidated and are in urgent need of an upgrade. The lobbies were no longer as clean as before, and the service quality of the property management was getting increasingly worse.

In order to solve these problems, we need to pass resolutions to repair and maintain these facilities at Property Owners General Meeting with enough approval votes from property owners. Currently, we are unable to reach the owner of your apartment and are unable to help you improve the community as you have always wanted. Therefore, we’d like to ask for your kind help to:

1) Pass on this letter to your landlord, and ask him/her to contact us (using the contact information below) — or —
2) Give us the contact information of your landlord, so we can contact him/her. We promise the information you provide will be solely used for the purpose of inviting your landlord to vote for these resolutions.

业主问答之十四:听说涨价是为了弥补亏损,物业亏损为什么还要做?

问:听说物业公司201和2020年都亏损了,他们为什么还在小区做?活雷锋吗?

答:的确,根据2019年报表,以及业委会发布的公告称,2019和2020年都是亏损的。但是需要注意的是,这个亏损是业主大会亏损,是全体业主亏损,而不是物业公司亏损。

无论什么情况,现在的物业公司收到业主缴纳的物业费以后,先收取10%作为物业公司利润,这部分是铁打不动的,所以物业公司每一年稳定的10%的利润从来没有变过,未来如果不更换物业公司也不会发生改变。

那么是谁亏损了呢?是业主亏损。也就是说,业主每天缴纳的物业费,扣除物业公司利润,以及所有的物业管理人员,一线工作人员工资,以及小区的维护成本,水电煤以后,剩余为负数。

也就是说,亏损的意思是,我们全体小区业主,因为物业管理公司的管理失职,成本虚高等原因,在2019年还欠管理公司14万块钱,估计2020年业主会欠物业公司的钱更多,所以业委会11月19日的公告中第六条称,希望把物业费提高到9.5元用以弥补历年亏损。

我们认为是因为物业公司完全不听从业主意见,失于管理,所以所产生的亏损业主并不承担,并且不能以亏损作为涨价的理由。
